1. Acceptance of Terms

By accessing and using Learn Extraqube ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

5. No Refund Policy

All purchases on Learn Extraqube are final and non-refundable. By completing a purchase, you acknowledge and agree that:

All subscription fees and course payments are non-refundable under any circumstances
You have reviewed the course content, features, and pricing before purchase
Digital content is delivered immediately upon payment, waiving any cooling-off period rights
Partial refunds for unused subscription periods are not available

In exceptional cases, Learn Extraqube may, at its sole and absolute discretion, consider refund requests. Any such decision by Learn Extraqube shall be final and binding, and shall not establish any precedent for future requests.

6. Intellectual Property

All content on the Platform, including but not limited to videos, text, graphics, logos, and software, is the property of Learn Extraqube or its content providers and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without explicit permission.

7. Prohibited Conduct

You agree not to:

Share your account credentials with others
Download, copy, or redistribute course content
Use automated systems to access the Platform
Interfere with or disrupt the Platform's operation
Violate any applicable laws or regulations
Harass or harm other users or instructors

8. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We do not guarantee that the Platform will be uninterrupted, error-free, or secure. Course content is for educational purposes only and should not be considered professional advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) Learn Extraqube's total cumulative liability to you for any and all claims arising from or related to these Terms or your use of the Platform shall not exceed the amount you paid to Learn Extraqube in the twelve (12) months preceding the claim; (b) Learn Extraqube shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, regardless of whether Learn Extraqube was advised of the possibility of such damages; (c) Learn Extraqube shall not be liable for any damages arising from your reliance on course content or any decisions made based on such content.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions. You agree that any dispute shall be subject to the exclusive jurisdiction of the courts of Thailand.

12. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall be resolved as follows:

You must first attempt to resolve the dispute by contacting our support team at [email protected]
If the dispute cannot be resolved within thirty (30) days, either party may submit the dispute to binding arbitration in Bangkok, Thailand
The arbitration shall be conducted in accordance with the Arbitration Rules of the Thai Arbitration Institute
The decision of the arbitrator shall be final and binding on both parties, and judgment may be entered in any court of competent jurisdiction
Each party shall bear its own costs and expenses, including attorney fees

CLASS ACTION WAIVER: YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13. Indemnification

You agree to indemnify, defend, and hold harmless Learn Extraqube, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit to the Platform.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, such provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Learn Extraqube regarding your use of the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.
